1. About CASAGATE

CASAGATE is a community management platform designed for apartment associations, gated communities, RWAs, villa communities, and property managers in India. Our services are intended to help committees and residents manage communication, maintenance, visitors, complaints, security workflows, and related community operations.

Important: CASAGATE is currently in active development. Features, pricing, availability, and timelines described on our website are indicative and may change before public launch. Nothing on this website constitutes a binding offer until confirmed in a separate written agreement.

2. Acceptance of Terms

By accessing https://casagate.in, requesting a demo, joining early access, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using our services on behalf of a housing society, apartment association, RWA, or other organization, you represent that you have authority to bind that organization to these Terms.

3. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding agreement under Indian law. Our services are intended for authorized representatives of communities, such as committee members, office bearers, property managers, and facility administrators.

4. Early Access and Beta Program

If you join our early access or beta program:

• You understand the platform may be incomplete, unstable, or change without notice
• Features may be added, modified, or removed during development
• We may limit the number of participating communities and select participants at our discretion
• Feedback you provide may be used to improve the product without obligation to you
• Early access does not guarantee future pricing, features, or continued availability

We will make reasonable efforts to communicate material changes affecting beta participants, but we do not guarantee uninterrupted access during the development phase.

5. Permitted Use

You agree to use our website and services only for lawful purposes and in accordance with these Terms. You must not:

• Use the services in any way that violates applicable Indian or local laws
• Submit false, misleading, or unauthorized information
• Attempt to gain unauthorized access to our systems, accounts, or data
• Interfere with or disrupt the integrity or performance of our website or services
• Scrape, copy, or reverse engineer our website or software except as permitted by law
• Use our services to harass, abuse, or harm others
• Upload malware, spam, or harmful code

6. Accounts and Access (Future Services)

When CASAGATE launches operational products, community administrators and users may receive accounts subject to additional terms. You will be responsible for maintaining the confidentiality of login credentials and for all activity under your account. Notify us promptly of any unauthorized use.

7. Community and Resident Data

When using CASAGATE on behalf of a community, you are responsible for ensuring that:

• You have a lawful basis to collect and share resident, visitor, and committee data with us
• Relevant notices and consents are provided to residents and data principals as required by law
• Data submitted is accurate and limited to what is necessary for community management purposes

We will process community data in accordance with our Privacy Policy and any applicable data processing agreement entered into with your organization.

8. Intellectual Property

All content on our website and platform — including text, graphics, logos, icons, software, designs, and trademarks — is owned by CASAGATE or its licensors and is protected by intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works from our content or software without our prior written consent, except for personal, non-commercial viewing of the website or use expressly permitted under a separate agreement.

9. Communications

By submitting a contact, demo, or early access form, you consent to receive communications from us related to your inquiry, product updates, and launch announcements. You may opt out of promotional emails at any time by following unsubscribe instructions or contacting support@casagate.in.

10. Disclaimers

To the fullest extent permitted by law:

• Our website and early access services are provided on an "as is" and "as available" basis
• We do not warrant that the website will be uninterrupted, error-free, or free of harmful components
• Information on our website is for general informational purposes and does not constitute legal, financial, or professional advice
• Mockups, previews, and roadmap descriptions are illustrative and not guarantees of final product functionality

11. Limitation of Liability

To the maximum extent permitted under applicable law, CASAGATE and its directors, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of our website or early access services.

Our total liability for any claim arising out of or relating to these Terms or your use of the website shall not exceed the amount you paid to us for the specific service giving rise to the claim in the twelve (12) months preceding the claim, or INR 5,000, whichever is greater.

Some jurisdictions do not allow certain limitations of liability; in such cases, our liability will be limited to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless CASAGATE from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of our services, or submission of data without proper authority or lawful basis.

13. Suspension and Termination

We may suspend or terminate your access to our website or early access program at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in conduct harmful to CASAGATE or other users.

Upon termination, provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will remain in effect.

14. Governing Law

These Terms are governed by the laws of India. Subject to Section 15, the courts at Coimbatore, Tamil Nadu shall have exclusive jurisdiction over disputes arising from or relating to these Terms or your use of our services.

15. Dispute Resolution

Before initiating formal legal proceedings, you agree to contact us at support@casagate.in and attempt to resolve the dispute informally within thirty (30) days. If the dispute is not resolved, either party may pursue remedies available under applicable law.

16. Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date at the top indicates when changes were last made. Continued use of our website after updated Terms are posted constitutes acceptance of the revised Terms. For material changes affecting active beta participants, we will make reasonable efforts to provide notice.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
